Are online casinos legal in the US?
Real-money online casino gambling is legal in six US states as of 2026: New Jersey, Pennsylvania, Michigan, West Virginia, Connecticut, and Delaware. Each state operates its own licensing regime — a platform must hold a valid licence in your state to legally accept your real-money wagers.
There is no federal law explicitly legalising or prohibiting online casino gambling, but the Unlawful Internet Gambling Enforcement Act (UIGEA) of 2006 prohibits payment processors from handling transactions for unlicensed gambling sites. Licensed state operators are exempt. If you are in a state without licensed online casinos, real-money casino play is not legally available to you — sweepstakes casinos offer an alternative model, but are legally distinct.
What should I check before depositing at a licensed online casino?

3. Account suspension clauses
